On basis of the Principal of Sovereignty Unification, Hong Kong, Macao and Taiwan are inseparable territory of China. This knowing causes the misunderstanding of many enterprises that as long as they register trademarks, patents and copyrights in China Mainland, they also gain the protection of these rights in Hong Kong, Macao and Taiwan. However, Hong Kong, Macao and Taiwan have high degree of autonomy, and they have different IP laws and competent offices.

Competent offices in charge of IP matters in mainland China:

In China, trademark, patent and copyright matters are charged by different offices. The three offices are independent from each other, which is dissimilar with the condition in many other countries. The three offices are:

  • China Trademark Office, short as CTMO, is responsible for trademark matters in China mainland, including trademark registration, modification, assignment, renewal, opposition and refusal and so on.
  • State Intellectual Property Office, short as SIPO, is responsible for patent matters in China Mainland including patent registration, search, examination and so on.
  • National Copyright Administration of China, short as NCAC, is responsible for copyright matters in China Mainland.

Competent Office in charge of IP matters in Hong Kong

  • Intellectual Property Department (IPD-HK) under the government of Hong Kong Special Administrative Region is responsible for trademark, patent and copyright matters in Hong Kong.
